  3. Is this impacting my loan?

This matter is regarding issues dating back to 2011 and identified during 2014 and 2015 regulatory exams and discussions. Mr. Cooper has resolved all these issues and worked closely with regulators to implement compliance procedures designed and established to ensure they do not recur. Most impacted customers were provided remediation years ago and were sent a letter of explanation or a statement on the monthly billing statement explaining the credit.

The settlement does not impact your obligation to pay your mortgage. You should continue to make your mortgage payments consistent with the terms of your loan and your monthly statements.

Certain customers will receive credits on their loan in the future, intended to address servicing issues Mr. Cooper agreed to remediate through the government settlement.

The first credit will be made no later than June 30, 2021, and additional credits will be made during the next three years, made on an annual basis provided you continue to make payments on your mortgage. Should you further modify your loan, you will no longer be eligible to receive the credits.

  11. How does this refund affect my bankruptcy?

For bankruptcy escrow remediation – the check is for a refund of the shortage that existed in your escrow account at the time your bankruptcy was over.

If you have filed for bankruptcy protection pursuant to Title 11 of the U.S. Code, this refund may constitute property of the bankruptcy estate. You should consult with your tax and/or legal advisors to determine whether you need to amend your bankruptcy schedules, or identify this refund to your creditors, the Bankruptcy Court, and any trustee.
